Terms of Service

By accessing or using Tokly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Tokly is a browser-based voice calling service that lets you place calls to telephone numbers worldwide using a prepaid credit balance. Tokly is not a regulated telecommunications carrier. It operates over the public internet and is subject to the quality limitations inherent to internet-based communication.

TOKLY DOES NOT SUPPORT EMERGENCY CALLS. You cannot use Tokly to reach emergency services such as 112, 911, 999, or any local equivalent. You must always have an alternative means of contacting emergency services — such as a mobile phone or a traditional landline — available to you at all times.

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using Tokly you represent that you meet these requirements.

Some features of the Service are available without an account. To purchase credits or access your call history, you must register with a valid email address. You are responsible for the security of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

Credits are prepaid — you add funds before placing calls. The per-minute rate for your destination is shown in the dialer before you connect.

• Credits do not expire.
• All prices are displayed in US dollars. The equivalent in your local currency is indicative only.
• Payments are processed by our payment provider. By completing a purchase you accept their payment terms.
• Credits are non-refundable once a call has been placed, except as required by applicable law.
• We reserve the right to adjust per-minute rates. Changes are effective immediately and displayed in the dialer before any call.

We may offer a referral program that rewards you with credit for inviting new users. Rewards are granted only for genuine referrals of new customers and are subject to the rules below.

• Self-referrals are not permitted — you may not refer yourself or claim a reward for your own sign-up or top-up.
• Creating multiple accounts to obtain additional rewards or bonuses is prohibited.
• To detect and prevent abuse, we may use signals such as a shared device, IP address, payment method, email address, phone number, or other technical data to link accounts.

We reserve the right to withhold or revoke referral rewards, suspend or terminate accounts, and disqualify participants if we reasonably believe the referral program is being abused, including but not limited to creating multiple accounts, self-referrals, fraudulent transactions, or any attempt to circumvent the program rules. The decision to grant or refuse any referral reward is at our sole discretion.

You agree not to use the Service to:

• place unsolicited, automated, or fraudulent calls (spam, robocalling, vishing)
• engage in traffic pumping, call pumping, revenue sharing (including international revenue share fraud), bypass fraud, artificial traffic generation, or any activity intended to generate telecommunications revenue rather than genuine person-to-person communication
• violate any applicable law, regulation, or third-party right
• harass, threaten, or harm any individual
• impersonate another person or entity
• resell, relay, or commercially redistribute the Service without our written authorisation

We may suspend calls in progress, restrict features, or suspend or permanently terminate accounts — without prior notice — where we reasonably suspect fraudulent or abusive activity, including before our investigation is complete.

If you use a custom caller ID, you confirm that you own or are authorised to use that number. Presenting a caller ID you do not own or control may be prohibited by law in your jurisdiction. You are solely responsible for compliance.

Tokly may offer optional call recording. If you enable recording, you are responsible for informing the other party and for complying with all applicable laws regarding consent to recording in your jurisdiction and theirs.

All software, design, content, and branding in the Service are owned by or licensed to Tokly. Nothing in these Terms grants you a right to copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

The Service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. Call quality depends on your internet connection and factors outside our control. We are not liable for failed, dropped, or poor-quality calls.

To the maximum extent permitted by applicable law, Tokly's total liability for any claim arising under or related to these Terms is limited to the credit balance in your account at the time of the claim. We are not liable for indirect, incidental, special, or consequential damages of any kind.

You may close your account at any time by contacting us. We may suspend or terminate your account immediately if you breach these Terms, or if we reasonably suspect a breach of these Terms or fraudulent activity. Where we reasonably determine that the Service has been used fraudulently or in breach of these Terms, we may withhold or permanently forfeit any unused credit; we may instead, at our sole discretion, refund unused credit to the original payment method. In all other cases, unused credit is non-refundable except as required by applicable law.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United Arab Emirates. Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of the United Arab Emirates.
